PCT国際段階成果物を利用した日欧間の特許審査ハイウェイ（PCT-PPH）試行プログラム（当該試行プログラムは2014年1月28日に終了）にもとづき、下記(a)-(c)のいずれかの国際段階における成果物のうち、最新に発行されたものを利用して、PCT出願を日本出願に移行するときに特許審査ハイウェイを利用することができます。
(a) 国際調査機関が作成した見解書(WO/ISA);
(b) 国際予備審査機関が作成した見解書(WO/IPEA);
(c) 国際予備審査報告(IPER).
ただし、上記(a)-(c)はいずれも、欧州特許庁が国際調査機関(ISA)または国際予備審査機関(IPEA)として作成したものに限られます。また、国際調査報告(ISR)のみにもどついてPCT-PPHを申請することはできません。
なお、上記(a)-(c)で引用された非特許文献についてはPCT-PPH申請時に提出が必要になります。

Q. Could the Applicant use PPH when entering an PCT application claiming the priority of an Dutch application into Japanese National Phase? Note that the ISR issued by European Patent Office identified that Claims 4 and 9 are patentable. If PPH is available, when and what conditions the Applicant use the PPH?
A. Generally, it is recommended to file PPH at the time of or shortly after filing the translation of the application, which will be within 2 months. However, it is possible to file PPH whenever you like until a Japanese examiner start examination process.
The Applicant needs to submit the latest international work product, i.e., one of the documents (a)-(c) below, which is issued most recently.
(a) Written Opinion of International Search Authority (WO/ISA);
(b) the Written Opinion of International Preliminary Examination Authority (WO/IPEA); or
(c) the International Preliminary Examination Report (IPER).
It should be noted that it is not allowed to request PCT-PPH on the basis of an International Search Report (ISR) only.
