選択要求に応答しても意識的限定にはなりません

Species I 図1(デコーダが2つある構成)
Species II 図2(デコーダを1つで兼用する構成)

となって、図1か図2のいずれかのspeciesを選択しなければならない状況において、クレーム1が、図1と図2の両方をカバーする請求項(デコーダが2つでも共用されていてもよい)という場合に、species I(図1)を選択してクレーム1をspecies Iに対応するものとして指定する応答をすると、クレーム1の権利範囲として図2のデコーダを1つで兼用する構成を意識的に除外したことになるか?

結論:審査官の選択要求に応答して、species I(図1)を選択してクレーム1をspecies Iに対応するものとして指定すること自体は、出願人の意識的限定とはならない。

選択要求はわかりにくいですが、species Iを選択すると、審査官は、クレーム1をspecies I に限定して審査し、species I が特許される場合は、次に、species II に広げて特許できるかどうか審査するということです。なので、選択要求に応答することが、ただちに出願人がクレーム1のスコープをspecies I に限定し、species II を意識的に除外したことにはなりません。

(もっとも、審査の過程で引例との関係で出願人がクレーム1をspecies I またはspecies II に限定する応答をすれば、出願経過禁反言が働くことはいうまでもありません。)

Under 37 C.F.R. § 1.146 (1997), if a generic claim embraces
more than one patentably distinct species, the examiner may
require the applicant to elect a species to which the claim will be restricted if no claim to the genus is found to be allowable. The examiner will then examine the elected species. If the species is patentable, the examiner will examine the other species, until either the full scope of the generic claim has been examined and found to be patentable, or until prior art is found over which a species is prima facie unpatentable.
